Upon booking one of our trips, you are contractually committed with Asia Viva Travel. The term “we” refer to “Asia Viva Travel”. The term “you” refer to the “customers”. The following terms & conditions are absolutely the basis of the contract.
1. COST & PRICES
All prices mentioned in tour’s program sent to customers are in United States Dollars (USD) and/or in Euro. Vietnam Dong are accepted with an exchange rate that is determined by the Vietnam Foreign Trade Bank (Vietcombank) as of the date of payment.
Asia Viva Travel commit keeping the prices that are mentioned in the tour program and on the invoices given to the customer. On the full cost or deposit payment, we commit to keep the final cost of your trip (excluding any changes made on your part). In some cases, we reserve the right to adjust tour prices due to forces majeure and travel conditions. The following force majeure may be considered:
The evidence of such force majeure will be informed ahead to the customer. In such cases, even after the payment of the deposit, the customer can refuse these increases and cancel the trip. And of cause, the deposit will be fully refundable.
2. DEPOSIT & RESERVATION
II- CANCELLATION POLICY & POLICY FOR CHILDREN
I. PAYMENT TERM
· A 30% deposit of the total cost is required upon confirmation of services.
· The balance of 70% must be paid no later than 14 days prior to the departure date
II. CANCELLATION POLICY (FIT FOR ALL MARKETS)
1. Cancellation by the Customer
If cancellation is made more than 30 days before the beginning of the trip:

Refund policies for domestic and international air tickets are subject to the regulations of each specific airline, depending on the ticket class and flight segment. The cancellation details will be provided after the travel consultant has worked with the respective airline.
2. Cancellation by Asia Viva Travel
Asia Viva Travel reserves the right to cancel a trip due to force majeure events such as war, natural disasters, port closures, fires, acts of terrorism, epidemics, etc.
Depending on the specific situation, cancellation fees imposed by service providers (e.g., hotels, airlines, transport companies, local partners) may vary and will be applied accordingly. Details of these charges will be communicated to the customer as soon as they are confirmed.
In all such cases, Asia Viva Travel will deduct applicable penalties from the deposit paid by the customer and refund the remaining amount via bank transfer. The customer will be responsible for all bank charges incurred.
III. CANCELLATION POLICY (GIT FOR ALL MARKETS)
1. Cancellation by the Partner
If cancellation is made more than 45 days before the beginning of the trip
(EUR will be applied for countries belonging to Eurozone)
Refund policies for domestic and international air tickets are subject to the regulations of each specific airline, depending on the ticket class and flight segment. The cancellation details will be provided after the travel consultant has worked with the respective airline.
2. Cancellation by Asia Viva Travel

IV. CANCELLATION POLICY (FOR GROUP TOUR ITALIAN MARKET + SIC B2B)
1. Cancellation by Clients:

The refund policy for domestic and international flight tickets varies depending on the airline, the ticket type and the flight segment. Detailed cancellation conditions will be provided once the travel consultant coordinates with the respective airline agencies.
2. Cancellation by Asia Viva Travel:

V. CANCELLATION POLICY FOR COMBINED TOUR: LAOS – CAMBODIA–THAILAND)
Cancellation policies for combined tours covering Laos, Cambodia and Thailand will be handled on a case-by-case basis, depending on the nature of the services booked, the seasonality and the specific cancellation terms of local suppliers in each country.
Due to the involvement of multiple service providers – such as hotels, airlines, cruise companies, and ground operators – across different destinations, each with its own cancellation conditions and timelines, Asia Viva Travel will review the situation individually and inform the partner or customer of the applicable fees at the time of cancellation.
We are committed to minimizing the cancellation charges wherever possible, but please note that in high or peak season periods, service providers may impose stricter and non-refundable terms. In these cases, the final cancellation charges will reflect the actual costs retained by third parties.
Asia Viva Travel will always provide a detailed breakdown of cancellation penalties once all conditions have been confirmed with relevant suppliers.

2. Cancellation Policy
Payment for the tour is a fundamental part of the tour’s income and contributes to the overall cost of equipment, running costs, staffing, administration, etc. As the Company will have incurred most of its costs before the tour starts, we need to impose cancellation charges to cover these costs.
Deposits are non-refundable. If you cancel your booking, we will impose cancellation charges as follows:
FIT BOOKING (UNDER 10 PAX) – Applied for booking with deposit payment
FIT BOOKING (UNDER 10 PAX) – Applied for booking without deposit
GIT BOOKING (FROM 10 PAX) – Applied for booking with deposit payment
GIT BOOKING (FROM 10 PAX) – Applied for booking without deposit payment
All cancellations must be in writing and be made by the person who submitted the booking form.
Once the tour has started, no refund for any unused portion or part of the tour or services to be provided will be given. If you want to make any changes to the tour, or depart the tour early, such alteration or departure will be entirely at your own expense and liability. You will also need to communicate in writing to the tour operator your reason for leaving the tour.

6. COMPLAINT & RESOLUTION
Any claim relating to a trip, or a service must be reached to Asia Viva Travel headquarter no later than 5 working days by a letter or email or phone call with acknowledgment of receipt.
In case of dispute, both parties will seek together an alternative resolution. Otherwise, the International Arbitration Center of Vietnam will have sole jurisdiction to arbitrate the dispute.
