I- BOOKING CONDITIONS

 

Upon booking one of our trips, you are contractually committed with Asia Viva Travel. The term “we” refer to “Asia Viva Travel”. The term “you” refer to the “customers”. The following terms & conditions are absolutely the basis of the contract.

 

1. COST & PRICES

All prices mentioned in tour’s programme sent to customers are in United States Dollars (USD) and/or in Euro. Vietnam Dong are accepted with an exchange rate that is determined by the Vietnam Foreign Trade Bank (Vietcombank) as of the date of payment.

Asia Viva Travel commit keeping the prices that are mentioned in the tour programme and on the invoices given to the customer. On the full cost or deposit payment, we commit to keep the final cost of your trip (excluding any changes made on your part). In some cases, we reserve the right to adjust tour prices due to forces majeure and travel conditions. The following force majeure may be considered:

  • An unpredictable and significant increase in our local service providers (hotels, trains, airfare, junks, boats)
  • A significant currency fluctuation and the new tax obligation applied by the Government.

The evidence of such force majeure will be informed ahead to the customer. In such cases, even after the payment of the deposit, the customer can refuse these increases and cancel the trip. And of cause, the deposit will be fully refundable.

 

2. DEPOSIT & RESERVATION

  • All bookings confirmation should be sent and submitted to Asia Viva Travel by email or by a writing document.
  • Reservations will be implemented and confirmed to customers after a deposit equivalent to 30% of the total cost is paid ahead.
  • If your trip is planned at less than a week (7 days), a full payment or a deposit of 50% of the total cost will be required.
  • A bigger deposit amount may be required for last-minute bookings or special requests from high grade hotels or airfare.
  • A confirmation of booking and a final invoice will be sent to the customer by email.
  • The balance payment must be made upon arrival, without a reminder from us.

 

3. PAYMENT

The payment can be made by cash, by bank transfer or by secure online methods

  • Cash payment will be made at Asia Viva Travel office in Hanoi, with no additional fees.
  • Credit cards: Visa Card, MasterCard, American Express and JCB. Any bank charge is to be paid by the customer.
  • Bank transfer: bank charge is to be paid by the customer.

 

4.CANCELLATION

4.1. Cancellation by the customer

  • Less than 30 days prior to the arrival date: 10% of total cost.
  • Less than 20 days prior to the arrival date: 20% of total cost.
  • Less than 10 days prior to the arrival date: 50% of total cost.
  • 3 days and no show: Full charge of total cost.

Refund policy for domestic and international air tickets varies by specific airline, type of ticket and flight segment. Details of the cancellation policy will be announced after the travel consultant works with the airlines agency.

 

4.2. Cancellation by Asia Viva Travel

Asia Viva Travel reserves the right to cancel trip for reasons related to force majeure situations such as: war, natural disaster, a port blockade, fires, terrorist actions, epidemic…..
In all cases of cancellation, Asia Viva Travel will charge an amount of these penalties on the deposit paid by the customer but will refund the remaining amount by bank transfer. The customer will bear all bank charges.

 

5. DISCOUNT FOR CHILDREN
Asia Viva Travel offer a 50% discount on the trip cost for a child aged 2 to 8 years old and 100% for a baby under 2 years old (except for airfare and train tickets). Children must be accompanied by at least two full-rate adults. In terms of accommodation during the trip, children will stay in a same room of their parents. An extra bed is chargeable.

 

6. COMPLAINT & RESOLUTION
Any claim relating to a trip, or a service must be reached to Asia Viva Travel headquarter no later than 5 working days by a letter or email or phone call with acknowledgment of receipt.
In case of dispute, both parties will seek together an alternative resolution. Otherwise, the International Arbitration Center of Vietnam will have sole jurisdiction to arbitrate the dispute.

The website aims to provide you with advices and informations on trips to Vietnam, Cambodia, Laos, Thailand and Myanmar as well as to present the services of Asia Viva Travel.

Asia Viva Travel reserves the right for whatever reason and at its sole discretion, to terminate or modify all or part of the website without prior notice.

When you visit our website, you can certainly verify the reliability and the accuracy of our data. We need to collect certain personal data about you.

  • Your name, address, email address, phone number, WhatsApp
  • Information relates to your trip and your wishes.

The necessary informations are presented on the different forms such as:

  • Communications with our travel consultant by email, messages (Facebook, WhatsApp) or telephone
  • Your passport to make a reservation for airfare tickets or to carry out a procedure to obtain your visa for a stay in Vietnam, Cambodia, Laos, Thailand or Myanmar.

 

Asia Viva Travel uses the collected data for the following reasons:

  • Carry out activities relating to the management of travelers regarding contracts, reservations of services, invoices and monitoring of your trip.
  • Manage customer opinions on our services through your testimonials.
  • Manage unpaid debts and unforeseen disputes regarding the use of our services.
  • Receive your payment statement.
  • Carry out our policy in favor of loyal customers.

 

Asia Viva Travel commit to keep your personal data collected in complete confidentiality while respecting your rights.

 

Asia Viva Travel reserves the right to modify this Privacy Policy, in whole or in part, at any time. We will inform you in advance by any useful means.
